Terms and Conditions for Ticket Sales
This translation is provided for convenience. Only the German version is legally binding.
1. Scope, contracting party and operator
(1) These terms apply to all contracts for the purchase of admission tickets ("tickets") through the website app.qwiktix.de.
(2) The customer's contracting party is the organiser of the event in question (the "organiser"). The organiser's name, address and contact details are shown on the event page, during checkout and in the order confirmation.
(3) The website is operated by Ramzi Hijjawi (e.K), Wrangelstraße 77, 10997 Berlin, Deutschland (the "operator"). The operator provides the ticket shop technically and does not become a party to the customer's contract. Contact the operator at support@ramzihijjawi.me.
(4) Any conflicting terms of the customer do not apply unless the organiser expressly agrees to them.
2. Formation of the contract
(1) The events and tickets shown on the website are not a binding offer but an invitation to place an order.
(2) Ordering works as follows: the customer chooses the ticket type and quantity, enters their name and email address and chooses a payment method. Before submitting, the customer sees a summary of the order with the total price and can check and correct every entry using the form fields and the quantity buttons, or go back to the ticket selection. By clicking "Zahlungspflichtig bestellen" (German) or "Buy now" (English) the customer makes a binding offer to buy the selected tickets.
(3) The contract with the organiser is formed when the payment has been completed successfully and the order is confirmed by email. This email contains the link to the customer's ticket page. For free tickets, the contract is formed with the confirmation email.
(4) The contract languages are German and English. The German version of these terms prevails.
(5) The contract text (order details and these terms) is stored. The customer receives the order details and these terms with the confirmation email. The current terms are always available on the website. The customer can open their tickets again at any time using the link in the confirmation email.
3. Prices and payment
(1) All prices are final prices and include statutory VAT where applicable. No additional fees are charged.
(2) Payment is processed by the payment service provider Stripe. The available payment methods are shown on the event page and during checkout. The price is due immediately when the order is placed.
(3) Selected tickets are held for the customer while they pay, for at most 30 minutes.
4. Tickets and admission
(1) Tickets are provided electronically only, on the ticket page whose link the customer receives by email. The QR code for admission appears there from 24 hours before doors open. It changes every 30 seconds and each code is valid for at most 5 minutes. If the organiser offers offline tickets for an event, the customer can also download a static offline version from that time.
(2) Each ticket admits one person once to the stated event. At the entrance the QR code is scanned and the ticket is invalidated. Expired QR codes, screenshots and typed codes do not grant admission. Whoever first shows a valid QR code for the ticket is admitted. The customer must therefore keep their tickets away from third parties.
(3) The organiser may ask for official photo ID at the entrance, in particular to check the minimum age. If a minimum age is stated for an event, people below that age will not be admitted, and the ticket price will not be refunded in that case.
(4) The house rules of the organiser and the venue operator apply. People who endanger the safety or running of the event may be refused entry or removed from the event.
5. Passing on tickets
Tickets may be passed on privately and non-commercially. Commercial resale and resale above the price paid are prohibited.
6. No right of withdrawal
There is no right of withdrawal. Under § 312g(2) no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for services related to leisure activities where the contract provides for a specific date or period of performance. This applies to tickets for events on a fixed date. Every order is therefore binding once "Buy now" has been clicked.
7. Cancellation and postponement
(1) If an event is cancelled, the organiser refunds the ticket price paid via the original payment method.
(2) If an event is postponed, tickets remain valid for the new date. If the customer cannot attend the new date, the organiser refunds the ticket price paid on request, provided the request reaches the organiser before the new date.
(3) Changes to the programme or individual performers that do not substantially change the overall character of the event do not entitle the customer to a refund.
8. Liability
(1) The organiser is liable without limitation for damage arising from injury to life, body or health, for damage caused intentionally or through gross negligence, and under the Product Liability Act.
(2) For slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely), the organiser's liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
(3) The organiser is liable for cloakroom items and belongings brought along only as set out in paragraphs 1 and 2.
9. Data protection
Information on how personal data is processed is in the privacy policy at https://app.qwiktix.de/datenschutz.
10. Dispute resolution
The organiser is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
11. Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) If any provision of these terms is invalid, the remaining provisions remain valid.
